SUEJECT:. MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES – CLARIFICATIONS REGARDING.

The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum of even number dated the 19th May, 2009 regarding the Modified Assured Career Progression Scheme (MACPS). Consequent upon introduction of the Scheme, clarifications have been sought by various Ministries/Departments about certain issues in connection with implementation of the MACPS. The doubts raised by various quarters have been duly examined and point-wise clarifications have accordingly been indicated in the Annexure.

2 The MACPS should strictly be implemented in keeping with the Department of Personnel and Training Office Memorandum of even number dated 19.05.2009 read with the aforesaid clarifications (Annexure)

3. All Ministries/Departments may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

S.No Point of doubt Clarification
1 Whether the Pay Band would change in the hierarchy of Pay Bands & Grade Pay on grant of the benefits under MACPS? Yes. The upgradations under MACPS is to be granted in the immediate next higher grade pay in the hierarchy of recommended revised pay (band and grade pay as prescribed in the CCS, (RP) Rules, 2008.
2 Whether the benefits of MACPS would be allowed to the Government servants who have been later on inducted in the Organized Group “A” Service No. The benefits under MACPS is not applicable to Group ‘A’ officer of Organised Group ‘A’ Services, as the officer under Organized Group ‘A’ Services have already been allowed panty of two years on non-functional basis with the officers of Indian Administrative Service (IAS)
3 How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008? The new MACPS has come into existence w.e.f. 01.09.2008. However, the pay structure has been changed w.e.f. 01.01.2006. Therefore the previous ACPS would be applicable in the new pay structure adopted w e f . 01.01.2006. Para 6.1 of Annexure-1 of MACPS is only for exercising option for coming over to the revised pay structure and not for grant of benefits under MACPS. The following illustrations would explain the position:

(A) In the case of isolated post:

Date of appointment in entry Grade in the pre-revised pay scale of Rs.4000-6000: 01.10.1982

1st ACP granted on 09.08.1999 : Rs.4500-7000 (pre-revised)

2nd ACP due on 01 10 2006 : Rs.5000-8000 (pre-revised) [revised PB-2 Grade Pay of Rs.4200]

3rd financial upgradation under the MACPS would be due on 01.10 2012 (on completion of 30 years of continuous regular service) in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay i.e. Grade Pay of Rs.4600 in PB-2.

(B) In the case of normal promotional hierarchy:

Date of appointment in entry Grade in the pre-revised pay scale of Rs.5500-9000: 01.10.1982

1st ACP granted on 09.08.1999 :Rs.6500-10500 (pre-revised)

2nd ACP due on 01.10.2006 (as per the existing hierarchy) :Rs.10000-15200 (pre-revised).

Therefore, 2nd ACP would be in PB-3 with Grade Pay of Rs.6600 (in terms of hierarchy available):

3rd financial upgradation under MACPS would be due on 01.10.2012 in the immediate next  higher grade pay in the hierarchy of recommended revised pay band and grade pay of Rs.7600.

4 Whether the benefits of MACPS would be granted from the date of entry grade or from the date of thew regular servlce/approved service counted under varlous service rules The benefits under MACPS would be available from the date of actual joining of the post in the entry grade
5 In a case where a person is appointed to an ex-cadre post in higher scale on deputation
followed by absorption. whether the period spent on deputatlon perlod would be counted as continuous servlce in the grade or not for the purpose of MACPS
(i) Where a person is appointed on direct recruitment/deputation basis from another post in the same grade, then past regular service as well as past promotions/ACP, in the earlier post, will be counted for computing regular service for the purpose of MACPS in the new hierarchy.

(ii) However, where a person iS appointed to an ex-cadre post in higher scale initially on deputation followed by absorption, while the service rendered in the earlier post, which was in a lower scale cannot be counted, there is no objection to the period spent initially on deputation in the ex-cadre post prior to absorption being counted towards regular service for the purposes of grant of financial upgradation under MACPS, as it is in the same Pay band/grade pay of the post.

6 Whether the pay scale/grade pay of substantive post would be taken into account for appointment/selection to a higher post on deputation basis or the pay scale/grade pay carrying by a Government servant on account financial upgradation(s) under ACP/MACP Scheme The pay scale/grade pay of substantive post would only be taken into account for deciding the eligibility for appointment/selection to a higher post on deputation basis.
7 In a case where 1st/2nd~ financial upgradations are postponed on account of the employees not found fit or due to departmental proceedings, etc. whether this would have consequential effect on the 2nd/3rd financial upgradation or not. Yes. If a financial upgradation has been deferred/postponed on account of the employee not found fit or due to departmental proceedings, etc.. the 2nd/3rd financial upgradations under MACPS would have consequential effect. (Para 18 of Annexure-1 of MACPS referred).
8 In a case where the Government servant have already earned three promotions and still stagnated in one grade for more than 10 years, whether he would be entitle for any further upgradation under MACPS No. Since the Government servant has already earned three promotions, he would not be entitled for any further financial upgradation under MACPS.
9 Whether the pre-revised pay scale of Rs.2750-4400 in respect of Group ‘D’ non matriculate employees, would also be taken as merged to grade pay of Rs.1800 for the purpose of MACPS in view of merger of pre-revised pay scales of Rs.2550-3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000, which have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band PB-1. Yes
10 If a Govt Servant on deputation earns upgradation under MACPS in the parent cadre, whether he would be entitled for deputation (duty) allowance on the pay and emoluments granted under the MACPS or not? No. While eligibility of an employee for appointment against ex-cadre posts in terms of the provisions of the RRs of the ex-cadre post will continue to be determined with reference to the post/pay scale of the post held in the parent cadre on regular basis (and not with reference to the higher scale granted under ACPS/MACPS). such an officer, in the event of his selection, may be allowed to opt to draw the pay in the higher scale under ACP/MACP Scheme without deputation allowance during the period of deputation, if it is more beneficial than the normal entitlements under the existing general order regulating pay on appointment on deputation basis.
11 Since the pay scales of Group “D” employees have been merged and placed in the Grade Pay of Rs.1800, whether they are entitled for grant of increment @ 3% during pay fixation at every stage. Yes. On the analogy of point 22 of Annexure-1 of MACPS, the pay of such Group “D” employees who have been placed in the Grade Pay of Rs.1800 w.e.f. 01.01.2006 shall be fixed successively in the next three immediate higher grade pays in the hierarchy of revised paybands and grade pays allowing the benefit of 3% pay fixation at every stage.

    Joined in Govt. organization 0n 30th Jan89,In a cadre hierarchy was as follows: Rs.5000-8000 Rs.5500-9000 , Rs.6500-10500) and Rs.7500-12,500 (pre-revised). on implementation of 6th CPC Revised pay scale is 9300-34,800/ with 4200 G.P on Ist Appointment,Revised pay scale is 9300-34,800/ with 4800 G.P and further with 5400/-GP in Group-A in promotional cadre Hierarchy and my contention is that Individual have to receive G.P.4800/- on completion of 12 years of service(Under ACP’s) in a pay Scale 9300-34,800 with 5400/-GP in PB-2 after completion of 20 years service and after completion of 30 years of service 5400/- in PB-3 -in promotional hierarchy ;it In terms of clarification given on point of doubt no.3 issued vide DOPT’s O.M. No.35034/3/2008-Estt.(D) dated 9.9.2010, the benefits of ACPS would be applicable in the new pay structure adopted w.e.f. 1.1.2006 in the promotional hierarchy. kindly clarify it what would be correct scale after implementation of 6th CPC

  4. I joined ITBP Force on 23.01.1988 in pay scale 1400-2300 (Sub Insp) and I got promotion in pay scale 1640-2900 ( Inspector) w.e.f. 25.06.1992. No further promotion due to low medical category w.e.f. Feb.1999. Also not granted me ACP scheme benefit due to category. As per MACP, Deptt granted me 2nd MACP w.e.f 01.09.2008 grade pay Rs.4800/- .
    Kindly clarify
    1 .I am eligible for 3rd MACP after 20 years regular service from first promotion i.e 25.06.2012 or otherwise.
    2. My next promotion from Inspector to Asstt. Comdt.ie GP 4600 to 5400 but deptt.given me GP 4800.
    3. Deptt ask me 3rd MACP can be granted after 30 years service but junior get more Grade pay.

  5. I have joined KVS (Autonomous Body) on 05.12.1996 as LDC. I got 1st MACP on 01.09.2008.
    I was appeared in Limited Departmental Exam in Year 2013. I cleared the same and offered promotion as UDC on 08.03.2013. But due to my personal problem, I did not accept the promotion. KVS had debarred me for the promotion for the period 08.03.2013 to 07.03.2014.
    I have also not got any regular promotion by KVS till date. My 2nd MACP will be due w.ef. 05.12.2016 as I will complete 20 years of my service as LDC.
    Kindly clarify is there any impact on my 2nd MACP due to refusal of promotion through Limited Departmental Exam specially kindly clarify whether I am eligible for drawing of 2nd MACP.

  6. Sir I have joined as LDC in MES in the year 2010. with a grade pay of 1900. After completing of 10 years of service what would be my grade pay when i get MACP? will it be 2000? or 2400?

    I retired from Coal Mines Provident Fund Dhanbad (Ministry Of Coal) on 31/07/2008. My second ACP awarded in the month of march 2006, During fixation of my pay as per 6th CPC, ACP calculated in old scale. The 6th pay commission recommended MACP vide OM No:- 35034/3/2008 Dated 19/05/2008. At the time of ACP my pay scale was fixed (5500-175-9000) Rs 6900/-pm.
    Kindly inform me whether i am entitled for 6th CPC’s MACP benefits.

    My Date of joining is 09.03.1990. I got ACP-1 on 09.03.2012 & MACPS-1 on 01.09.2008. On two occasions in 2007 & 2008 I was offered promotion. Since I refused promotion on both occasions and total debarred is two years. On 25.05.2010 I was promoted. No fixation was given as it was given at the time of MACPS-1 only change of Grade pay was given.
    As per para-25 of MACPS “If a regular promotion has been offered but was refused by the employee before becoming entitled to financial upgradation, no fixation shall be allowed as such an employee has not been stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, not be eligible to consider for further financial upgradation till he agrees to be considered for promotion again and the second the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal”. In my case I was givenACP-1 & MACP-1 and subsequently I refused promotion. I wish to know that whether I am eligible of MACP-2 on 25.05.2012 i.e. deferred period of two years of debarment due to refusal. If not, then when I will become eligible of next MACPS.

  9. Sir, I was appointed in Ministry of Defence (DGQA)in 24/8/83 as C/M II in pre-revised pay scale of 5000-8000. I got Ist ACP/Promotion prior to 01/01/06 in pre-revised scale of 5500-9000. Due to merger of above scales and completion of more than 12 years on 01/01/06 and 24 years on 24/8/07 (between 01/01/06 & 30/08/08), please clarify whether I am eligible for I ACP w.e.f. 01/01/06 (GP 4600) & II ACP (GP 6600)w.e.f. 24.08/07 as clarified by DOPT vide OM No.35034/3/2008 Estt(D) dt 09/09/10 ?. Is it applicable to DGQA also ?.In my deptt for getting GP 6600 two more posts corresponding to pre-revised scale 7500-12000 & 8000-13500 are also available. Now recruitment rules are also revised. My doubt may please be clarified. Thanking you,

    ACP in 1999 -(dt of implementation of AcP)and took VRS on 30/9/2008(completed

    20 yrs on31.12.2005)

    What r my entitlements for MACP

    i was appointed as a group C employee in 1991 with the grade pay of RS 2800/- (direct entry).
    Within the 21 years of my regular service i got two promotions on scale of Rs 5000/- and 5500/- on the same grade pay Rs 4200/- if it is hierarchical, am i entitled for the MACP/grade pay Rs 4600 ?

  12. I was appointed as Group D employee on 1.5.1972 and by viture of qualifying departmental competitive exam got promotion as LDC on 16/12/1977. Subsequently, got IInd. ACP w.e.f. August 1999 and after that got regular promotion as U.D.C 14.10.2004 in the scale of 4000-6000. On implementation of 6th. pay commission I got Grade pay Rs. 2800/- and after rendering more than 39 years of service, retired on 30.11.2011 in the same grade pay(2800).

    I wanted to know whether the grade pay granted to me is in accordance with the existing rule or not.

  13. I WAS PROMOTED AS EXAMINER FROM PAY SCALE 2650 TO 2750. WHICH IN VI CPC IS BEING MERGED,LATER THAN I REFUSED TO TAKE PROMOTIONS. NO MAY RENDER SERVICE IS ABOUT 30 YEARS, WHETHER AM I ELIGIBLE FOR MACP SCHEME

  14. I have joined as LDC on 10.09.1984. I have been promoted as UDC on 03.03.1999 i.e. after putting off 14 years 6 months service in the pre-revised pay scale of 4000-6000 . On 10.09.2008 i.e. completion of 24 years of regular service. I got my 2nd financial up gradation according to ACP scheme in the pre-revised pay scale of 5000-8000(revised pay scale Rs. 9300-34800 with grade pay of Rs. 4200/-) because till date there is no MACPs order issued.
    Now with implementation of MACPs I will be given the grade pay of Rs. 2800/-on completion of 24 years regular service. Authorities are requested to kindly clarify the matter whether granted grade pay of 4200/ is correct as my case comes under past cases or revised the grade pay of Rs. 2800/-. If so, when will I get my next financial up gradation.

  15. I am central govt servant . can I engage my relative in my office as contractual worker on daily wages through man power supply agency.

  16. I appointed as draftsman Gr-III in Oct 1985,( 4500-7000 ) Ist Promotion as draftsman Gr-II (5000-8000 ) given to me in the month of Apr. 1989 . Sir as per MACP 10,20,30 When I got 1st/2nd macp on Sep 2008 (GP-4600/- )& 2nd/3rd macp onApr. 2009 ( GP- 4800/- ) is it ok or not.

  17. I appointed as LDC in June 1985, Ist Promotion as UDCgiven to me in the month of Feb. 1992. IInd promotion as Asstt at Karnataka given to me on March 2003, but refuse the promotion due to transfer. Sir as per MACP 10,20,30 When I am eligble for upgradation as I am still working in same pay scale for more than 20 years.

Just In
