Dear Comrades,

The 47th meeting of the National Council was held on 13.4.2019 at Rail Bhawan, New Delhi, under the Chairmanship of Shri P.K.Sinha, Cabinet Secretary. It was held after the most inordinate delay i.e. after the lapse of nine years that the National Council meeting was convened. The decision of NJCA to organize Dharna on28.3.2019 (which was deferred) is what triggered the Government to convene the meeting.

The meeting commenced at 11.30 AM and ended at 2.30 PM. In the introductory remark, the leader and the Secretary Staff Side touched upon the following points.

  1. Survival of JCM ;revival of Departmental Councils; maintenance of its stipulated frequency.
  2. Closure of offices- restructuring consultation with the Staff Side and Unions affected; with particular reference to CPWD, Printing Presses and Defence Industry.
  3. Increasing litigations; Governments disregard to its own National litigation policy making employees and pensioners to incur huge expenditure. Non implementation of even Supreme Court decisions- MACP promotional hierarchy, MACP date of effect, increment on 30th June and 31st December etc
  4. NPS and other pension related issue
  5. Recognition Rules, delay in the grant of recognition
  6. Arbitration Awards.
  7. Non honoring of the assurance held out by the GOM to revisit the minimum wage and fitment formula
  8. One more option to switch over to the 7th CPC
  9. Non issue of clarification on the question of minimum pay for promotes after 1/1/2006
  10. Reduction in the quantum of Night Duty Allowances
  11. Ex-Service man pay fixation
  12. Compassionate Appointment and its restriction
  13. Outsourcing and Casualization of permanent Jobs
  14. Regularization of Casual workers- include casual service for pensioner benefits
  15. Running Allowance of Railway Workers with tax free banefit
  16. CGHS deficiencies
  17. Necessity to hold meetings by held and pension Secretary with Staff Side
  18. One time relaxation for LTC-80 fare

  1. 1)Why item no. 43 IT exemptionto those above 80 no decision is taken . Kept blank. 2)Why pension with GP 4600/- upgraded from S-12 to S-13 has not been included in the agenda
    3) FMA to those who r not members of departmental medical facilities but residing within 2.5 kms rejected. 2.5 km is arbitrary without the support of any statute but only a executive diatom catenary of casea the SC have held that a executive fiat should be supported by a statute. Who is the authority to certify whether one is residing within /beyond 2.5 kms Due to Road rules to may be 2.4 kms and from may be 2.8 kms due to one way etc so where do the line is drawn.
    I am a 85 yrs old Rly pensioner and butnot a member of RELHS but residing within 2.5 kms from Rly hospital and thus not claiming FMA since its inception.
    To choose medical facility is right to life under Art 21 of the constitution. Denying FMA to such a pensioner is ulta vires to Art 21, 14, and 16 of the Constitution. leading to denaying an 85 yrs old pensioner medical service.. But he has no physical and economic support to seek justice in CAT/HC which r situated in the Capital City while he resides in a city 150 kms away; let alone going to SC if need be..
    I desire to know under what statute 2.5 km is fixed and why l am denied, FMA which l am not claiming being an honest man while many may be claiming in the absence any checking Authority being with in 2.5 kms and some may be availing both -the FMA and dept medical service.
    cosidering all the above points I pray that those who r Not availing dept medical service be paid FMA irrespective of he residing within or beyond 2,5 kms. So that he can at least buy the day to day required medicines
    Otherwise it may be construed that this 85 yr old pensioner is denayed his right to life, vide Art 21.
